Summary:

  • My products are created for business customers like bloggers and content creators, not for personal use.

  • All items are digital and exclusive, so all sales are final and non‑refundable (unless required by law).

  • After purchase, you receive full economic copyright so you can use the content freely in your business, while I may still show the photos in my portfolio, social media, and marketing.

  • You may not resell or redistribute the original files, or use them as templates, presets, or courses for other creators.

Terms of Service

1. These products and licenses are intended for business customers, such as bloggers, content creators, and online publishers (B2B), not for personal consumer use.

2. Scope and customers

 These Terms of Service apply to all digital products sold through Chantal Rooth Photography (the “Store”).

Our products are intended for professional use by bloggers and other business owners. By purchasing, you confirm that you are buying for business purposes.

3. Digital products and no refunds

All items sold in the Store are digital products (recipes, images and related content).

Because of the digital and exclusive nature of these products, all sales are final and no refunds are offered, except where mandatory law requires otherwise.

4. Copyright Assignment (Transfer)

Upon full and final payment, the Photographer and Buyer enter into a legally binding Copyright Assignment Agreement, digitally executed by the Buyer at checkout. This agreement legally transfers and assigns all worldwide economic copyright ownership of the purchased recipe, images, and copy to the Buyer. This transaction does not constitute a "work made for hire."

5. Portfolio Reservation

The transfer of copyright is strictly conditioned upon the Buyer granting back a non-exclusive, perpetual, irrevocable, and royalty-free license to Chantal Rooth Photography to utilize the images from the purchased set for promotional purposes. This includes, but is not limited to, online portfolios, social media marketing, newsletters, and general photography business promotion.

6. Prohibited Uses of Retained Rights

Although you receive full copyright ownership through this assignment, to protect the integrity of the original creation, you may not:

Resell, sublicense, give away, share, or distribute the raw photo files, recipes, or copy as a standalone product to third parties (including stock platforms or other commercial brands).

Package the content as a template, course, bundle, or any other digital product for direct resale to other creators.

Register the copyright of the photography under your own name for the purpose of reselling or licensing the images to other creators (commercial sale of e-books or digital cookbooks directly to your blog's readers/consumers is fully permitted).

7. Pricing, taxes and payment

Prices are listed in USD and may change at any time.

Applicable taxes and payment processing fees are shown at checkout. You are responsible for any taxes, duties or charges required in your jurisdiction.

8.  Limitation of liability

To the fullest extent permitted by law, Chantal Rooth Photography is not liable for any indirect, incidental or consequential damages arising from the use of the Store, the recipes or the images, including lost profits or loss of data.

Nothing in these Terms limits any rights you may have under mandatory consumer or privacy law.

9. Changes to these Terms

I may update these Terms from time to time. The version published on this page at the time of your purchase applies to that purchase. Your continued use of the Store after changes are posted constitutes acceptance of the updated Terms.
